1. Scope of application

1.1 The sale of products via the Site (“Products”) constitutes a distance contract governed by Chapter I, Title III (articles 45 et seq.) of Legislative Decree 6 September 2005, n. 206 (“Consumer Code”) and by Legislative Decree 9 April 2003, n. 70, amended by Legislative Decree n. 21/2014, by Legislative Decree n. 70/2003 on electronic commerce and by EU Regulation 2018/302 of the European Parliament and of the Council containing the rules on electronic commerce. 1.2 These General Conditions of Sale apply to all sales made by “Cbweed Brindisi” on the site.

1.3 The General Conditions of Sale reported here may be modified at any time. Any modifications and/or new conditions will be in force from the moment of their publication in this section of the Site.

For this reason, users in the capacity of potential buyers are invited to regularly access the Site and to consult the most up-to-date version of the General Conditions of Sale before making any purchase.

The applicable General Conditions of Sale are those in force on the date the purchase order is sent.

The user is required to carefully read these General Conditions of Sale, which “Cbweed Brindisi” makes available to him in this section of the Site and which he is permitted to store and reproduce, as well as all other information that “CBWEED BRINDISI" provides him on the Site, both before and during the purchase procedure.

1.4 These General Conditions of Sale apply to the National and European territory.

They do not regulate the sale of products by parties other than “Cbweed Brindisi” that are present on the Site through links, banners or other hypertext links. “Cbweed Brindisi” is not responsible for the sale of products by such parties.

“Cbweed Brindisi” does not carry out any checks and/or monitoring on the websites that can be consulted via these links.

“Cbweed Brindisi” is therefore not responsible for the contents of such sites nor for any errors and/or omissions and/or violations of the law by the same. 2. Purchases on the site

2.1 Access to sales made through the Site is reserved exclusively for users who are 18 years of age or older.

2.2. The user acknowledges that, by accepting the general conditions of sale, he/she releases Cbweed Brindisi from any liability arising from the purchase of the product if this is in violation of the law of the country in which the product is sold.

The user is also required to inform himself whether the law / standards of his country provide or authorize the purchase of the products offered for sale by Cbweed Brindisi considering them legal.

Therefore, the user expressly exonerates Cbweed Brindisi from any violation of the law regarding the previous point, assuming all responsibility.

Cbweed Brindisi informs Customers that the products sold / offered for sale by the site are for technical and collectible use and as such cannot be used for any other use / purpose.

2.3 Access to the offers on the Site is permitted to users who are consumers, as defined by art. 3, co. 1, letter a) of the Consumer Code, meaning natural persons who, in relation to the purchase of the Products, act for purposes unrelated to any commercial, artisanal, entrepreneurial or professional activity they may carry out.

2.4 Under no circumstances may retailers or wholesalers or, in general, all persons intending to purchase the Products for the purpose of subsequent resale, make purchases on the Site. It is therefore forbidden for such persons to register on the Site and make purchases on the Site.

2.5 “Cbweed Brindisi” reserves the right to refuse or cancel orders that come from: (I) a user with whom it has an ongoing legal dispute; (II) a user who has previously violated these General Conditions of Sale and/or the conditions and/or terms of a purchase contract with “Cbweed Brindisi”; (III) a user who has been involved in fraud of any kind and, in particular, fraud relating to credit card payments; (IV) users who have provided false or incomplete identification data.

3. Site Registration

3.1 Registration on the Site is free. To register on the Site, the user must fill out the registration form, entering the name, surname, an e-mail address, password, status, gender.

Registration will be confirmed via email sent to the user who, to complete the registration procedure, must click on the appropriate link contained in the communication received.

3.2 The registration credentials must be used exclusively by the user and cannot be transferred to third parties.

The user undertakes to keep them secret and to ensure that no one has access to them, as well as to inform “Cbweed Brindisi” by contacting Customer Service in case of suspected improper use and/or disclosure of the same. The user guarantees that the personal information provided during the registration procedure on the Site is complete and truthful. Each user is allowed to register on the Site only once. The same user is prohibited from making multiple registrations. In the event that “Cbweed Brindisi.” should detect that the same user has made multiple registrations on the Site, “Cbweed Brindisi” reserves the right to proceed, immediately and without notice, to block the relevant account. The user agrees to hold “Cbweed Brindisi.” harmless from any damage, compensation obligation and/or sanction deriving from and/or in any way connected to the violation by

of the user of the rules on registration on the Site or on the storage of registration credentials.

4. Information aimed at consulting the contract

4.1 In accordance with Legislative Decree 9 April 2003, n. 70 containing provisions on electronic commerce, “Cbweed Brindisi” informs the user that: – to conclude the purchase contract for one or more Products on the Site, the user must fill out an order form in electronic format and send it to “Cbweed Brindisi”, electronically, following the instructions that will appear from time to time on the Site and that will accompany the various phases of the purchase; – the contract is concluded when the order form reaches the “Cbweed Brindisi” server; – before proceeding with the transmission of the order form, the user can identify and correct any data entry errors by following the instructions indicated from time to time on the Site and that will accompany the various phases of the purchase; – once the order form has been registered and confirmation of the authorization to pay the total amount due has been received, "Cbweed Brindisi" will send the user, via email to the email address indicated, the order confirmation, containing a summary of the General Conditions of Sale and the specific conditions applicable to the contract, information relating to the characteristics of the purchased Product, detailed information on the price, the means of payment used, information on the right of withdrawal, delivery costs (where applicable), any additional costs and the Customer Service contacts to which the user can turn to request assistance and/or submit complaints.

It is recommended to keep the email received as proof of purchase. The General Conditions of Sale applicable to the order, as well as the standard instructions on withdrawal and the standard withdrawal form referred to in art. 10 are available on the site.

The order form will be stored in the “Cbweed Brindisi” database for the time necessary to process the order and, in any case, within the terms of the law. 4.2 The language available to users for the conclusion of the contract is Italian and English.

Customer Service is able to communicate with users in the same languages. 5. Prices 5.1 All Product prices are expressed in Euros (€) and include Value Added Tax (“VAT”). Shipping costs and any other additional costs, including VAT and expressed in Euros (€), will be indicated in the order form, before the user proceeds to transmit the same, as well as in the order confirmation email.

5. Product Price

The price of the Products may be modified by “Cbweed Brindisi” at any time, without notice, it being understood that the price charged to the user will be the one published on the information sheet illustrating the main characteristics of the Product (“Product Sheet”) at the time the order is sent.

Any price variations (increases or decreases) subsequent to the transmission of the order will not be taken into account.

6. Purchase Orders – Product Information –

6.1 “Cbweed Brindisi” will process the purchase order, and therefore ship the purchased Product, only after receiving confirmation of the authorization to pay the total amount due, consisting of the purchase price, delivery costs (if applicable) and any other additional costs. In the event that the Total Amount Due is not paid or the successful outcome of the payment is not confirmed, the purchase contract will be considered terminated by law pursuant to and for the purposes of art. 1456 of the Civil Code. The user will be notified of such termination and the consequent cancellation of the order immediately after the order has been sent, via the Site.

6.2 The Products will remain the property of the partners of “Cbweed Brindisi” until the Total Amount Due has been paid by the user. The risk of loss or damage to the Products will be transferred to the user at the moment in which the payment of the price due is displayed by Cbweed Brindisi.

The user acknowledges that Cbweed Brindisi is in no way responsible for damage, delay, loss of the product from the moment the product is entrusted to the courier who handles the shipment.

6.3 The Products offered on the Site are the items present on the Site at the time the order is placed by the user.

6.4 Each Product is accompanied by a Product Sheet. The images and descriptions on the Site reproduce the characteristics of the Products as faithfully as possible. The colours of the Products, however, may differ from the actual colours due to the settings of the computer systems or computers used by users to view them. Furthermore, the images of the Product in the Product Sheet may differ in size or in relation to any accessory products. These images must therefore be understood as indicative and with the usual tolerances. For the purposes of the purchase contract, the description of the Product contained in the order form sent by the user will be valid.

7. Product Availability

7.1 The products offered on the Site are limited in number. It may therefore happen, also due to the possibility that multiple users purchase the same Product at the same time, that the ordered Product is no longer available after the transmission of the purchase order. Therefore, once the order request has been received, the Orders department of Cbweed Brindisi” reserves the right to reconfirm the availability of the purchased items, the validity of the credit card transaction and to verify the details of previous transactions carried out by the user on the website.

7.2 In the event of unavailability of the ordered Product, without prejudice to the rights granted to the user by law, and, in particular, by Chapter XIV of Title II of Book IV of the Civil Code, the user will be promptly informed by e-mail. The user will therefore be entitled to cancel the order. In the event that the user avails himself of the right of termination, “Cbweed Brindisi” will refund the amount paid without undue delay and, in any case, within the maximum term of 14 working days from the sending of the order. The amount of the refund will be communicated to the user by e-mail. This amount will be credited to the same means of payment used by the user for the purchase. Any delays in crediting may depend on the banking institution, the type of credit card or the payment solution used. In any case, the value date will be the same as the debit.

7.3 In the case of orders concerning a plurality of Products (“Multiple Order”), if the subsequent unavailability concerns only some of the Products in the Multiple order (without prejudice to the rights granted to the user by law, and, in particular, by Chapter XIV of Title II of Book IV of the Civil Code, and without prejudice to the application of art. 7.2 above) and if the subsequent unavailability concerns all the Products in the order, “Cbweed Brindisi” will immediately notify the user by e-mail. The user will therefore be entitled to cancel the order, limited to the Product(s) that have become unavailable/in compliance with the provisions of the Consumer Code. In the event that the user decides to cancel the order in relation to the Product(s) that have become unavailable or in any case in which the payment of the total amount due has already occurred, “Cbweed Brindisi” will refund the amount due in relation to such Product(s) within a maximum of 14 working days from completion of the shipment. The amount of the refund will be communicated to the user via email. This refund will be made to the IBAN that will be communicated by the User. Any delays in crediting may depend on the banking institution, the type of credit card or the payment solution used.

In any case, the value date will be the same as the charge. The resolution of the entire Multiple Order will be possible only in the case of evident and proven accessoriness of the Products subject to the Multiple Order that have become unavailable compared to the other Products subject to the Multiple Order that are available. 8. Delivery of the purchased products

8. Delivery

Shipping is subject to charges for purchases up to the sum of Euro 69.00, while for purchases exceeding this amount shipping and delivery are free. The amount of shipping costs due by the user in relation to a specific order is indicated (in Euros and inclusive of VAT) during the purchase process, in the order summary and, in any case, before the user proceeds to transmit the order.

In the event of failure to indicate a specific delivery date, delivery will, in any case, take place within thirty days from the date of conclusion of the contract.

8.2 The delivery obligation is fulfilled by transferring the material availability to the Carrier or in any case the control of the Products to the user.

It is up to the user to check the conditions of the Product that has been delivered to him. The user is advised to check the number of Products received and that the packaging is intact, not damaged, or otherwise altered and he is invited, in his interest, to indicate on the carrier's transport document, any anomalies, accepting the package with reservation.

The receipt and acceptance without reservation of the Products does not allow the user to make requests for attribution of responsibility towards Cbweed Brindisi and towards the courier. Without prejudice to the provisions of art. 6.2, in the event that the packaging shows obvious signs of tampering or alteration, the user is invited to promptly notify Customer Service. In any case, the application of the rules regarding the right of withdrawal remains unchanged.

8.3 The Products purchased on the Site will be sent and delivered to the address indicated by the user during the order. Home Delivery will be carried out, unless otherwise indicated, by the courier on the days indicated on the site.

“Cbweed Brindisi” reserves the right to use other carriers, subject to compliance with the delivery method chosen by the user and the delivery times indicated.

8.4 Upon delivery of the Products to the courier, the user will be sent a shipping confirmation email indicating the tracking number through which the user can check the status of the shipment. This email will also contain the information relating to the delivery procedure, the deadline for collection in the event of non-delivery due to the absence of the recipient and the consequences of failure to collect within the indicated time frame.

8.5 The user acknowledges that the collection of the Product is a specific obligation deriving from the purchase contract. In the event of failed delivery due to the absence of the recipient at the address specified in the order form, the courier will leave a card to certify the delivery attempt (so-called notice of passage). The card will indicate the telephone number that the user must contact to request that the courier make a second delivery attempt. After two failed delivery attempts, the package will be "in storage".

As soon as the package goes “in storage”, Customer Service will contact the user in order to unblock the storage and ensure that the package is delivered to them as soon as possible. In the event that the delivery attempt following the contact with Customer Service also fails, the package will be sent back to “Cbweed Brindisi”.

In reference to the previous point, the user acknowledges that, after thirty (30) days from when the package is returned to "Cbweed Brindisi", the contract may be considered terminated and the purchase order cancelled pursuant to art. 1456 of the civil code. Once the contract has been terminated, "Cbweed Brindisi." will proceed to refund the total amount due, if already paid by the user. The refund amount will be credited to the IBAN that will be communicated by the User. Any delays in crediting may depend on the banking institution, the type of credit card or the payment solution used. In any case, the value date will be the same as the debit. In the event that, before the thirty days mentioned above have elapsed, the user intends to receive the purchased Product again, he/she may contact Customer Service to receive all the information necessary to process the request.

9. Payment Methods

9.1 Payment for the Products can be made by credit card or by using the PayPal service. In the event that one of these payment methods/solutions cannot be used in relation to a specific Product, this will be clearly indicated on the Site, at the latest at the beginning of the purchase procedure.

9.2 The payment receipt will be issued automatically for each purchase. During the first purchase the user will be asked to provide the data for the header of the purchase order. For this the user declares to be truthful, committing to relieve “Cbweed Brindisi” from any damage, including sanctions pronounced by the competent authorities, which may arise in the event of failure to respect the truth.

10. Right of withdrawal

10.1 The user who has the status of consumer has the right to withdraw from the contract concluded with "Cbweed Brindisi", without having to specify the reason, within fourteen (14) calendar days (Withdrawal Period).

THE ORDER MUST THEREFORE BE RETURNED IN THE METHODS INDICATED BY "Cbweed Brindisi" WITHIN AND NO LATER THAN 14 WORKING DAYS, AFTER THIS PERIOD THE RETURN WILL NOT BE ACCEPTED

The Withdrawal Period expires after 14 days:

a. in the case of an order relating to a single Product: from the day on which the user or the carrier acquires physical possession of the Product;

b. in the case of a Multiple Order with separate deliveries: from the day on which the user or the carrier acquires physical possession of the last Product;

c. in the case of an order relating to the delivery of a Product consisting of multiple lots or pieces: from the day on which the user or the carrier acquires physical possession of the last lot or piece.

10.2 Exercising the right of withdrawal

To exercise the right of withdrawal in relation to an Order, the user must inform “Cbweed Brindisi” of his decision to withdraw, before the expiry of the Withdrawal Period. To make the request, he will simply need to connect to his area or contact Customer Service. He will then have to select the desired order and the product(s) he wants to return. He can complete the return request by filling in the reason for the return and any additional notes. At the end of the procedure, the user can print the return receipt to attach to the package and send to the address communicated.

10.3 The user, after having exercised the right of withdrawal with the methods indicated in articles 10.1, 10.2 above, must return the Product to "Cbweed Brindisi" using the indicated carrier. The printed receipt with the return number must be attached to the package. The return of the Product to "Cbweed Brindisi" occurs under the responsibility of the user.

10.4 If the user withdraws from the contract within the times and methods indicated, ”Cbweed Brindisi” will proceed to refund the amount paid by the user for the Product no later than 14 calendar days from the day. This date must be calculated from when the Product arrives at the ”Cbweed Brindisi” warehouses.

All this is subject to the verification of the integrity of the Product. The refund will be made to the IBAN that will be communicated by the User. In any case, the user will not have to bear any costs as a consequence of such refund. If the user exercises the right of withdrawal, the security seal on the Product must not be cut or broken. The Product must not have been opened or altered and must not show any signs of use. The returned product must be returned in the condition in which it was delivered.

10.7 In the event that the withdrawal is not exercised in accordance with the provisions of the applicable legislation, it will not entail the termination of the contract and, consequently, will not give the right to any refund.

11.2 “Cbweed Brindisi” will respond to complaints submitted within five working days of receiving them.

12. Exhaustiveness Applicable law and competent court; out-of-court settlement of disputes – Alternative Dispute Resolution/Online Dispute Resolution.

12.1 These General Conditions of Sale together with the information provided pursuant to art. 49 of the Consumer Code, before the user is bound by the contract, represent the entirety of the agreements between "Cbweed Brindisi." and the users of the Site with reference to the contracts concluded through the Site.

12.2 Contracts concluded between users of the Site and "Cbweed Brindisi" are governed by Italian law. The application to consumer users who do not have their habitual residence in Italy of any more favorable and mandatory provisions provided for by the law of the country in which they have their habitual residence is reserved, in particular in relation to the deadline for exercising the right of withdrawal, the deadline for returning the Products, in the event of exercising this right, the methods and formalities of communication of the same and the legal guarantee of conformity.

12.3 Please remember that in the case of a consumer user, any dispute relating to the application, execution and interpretation of these General Conditions of Sale will be subject to the jurisdiction of the court of the place where the user resides or has elected domicile.

12.4 Pursuant to art. 141-sexies, paragraph 3 of Legislative Decree 6 September 2005, n.206 (Consumer Code), ”Cbweed Brindisi” informs the user who qualifies as a consumer pursuant to art. 3, paragraph 1, letter a) of the Consumer Code, that, in the event that he has submitted a complaint directly to ”Cbweed Brindisi” following which it has not been possible to resolve the dispute thus arising, ”Cbweed Brindisi” will provide information regarding the Alternative Dispute Resolution body or bodies for the extrajudicial resolution of disputes relating to obligations arising from a contract concluded on the basis of these General Conditions of Sale (so-called ADR bodies, as indicated in articles 141-bis et seq. of the Consumer Code), specifying whether or not he intends to avail himself of such bodies to resolve the dispute itself. ”Cbweed Brindisi” also informs the user who qualifies as a consumer pursuant to art. 3, paragraph 1, letter a) of the Consumer Code that a European platform for the online resolution of consumer disputes (so-called ODR platform) has been established. The ODR platform can be consulted at the following address http://ec.europa.eu/consumers/odr/; through the ODR platform the consumer user will be able to consult the list of ADR bodies, find the link to the site of each of them and start an online dispute resolution procedure in which he is involved. In any case, the consumer user's right to appeal to the competent ordinary judge for the dispute arising from these General Conditions of Sale remains intact, regardless of the outcome of the out-of-court settlement procedure for disputes relating to consumer relationships by resorting to the procedures referred to in Part V, Title II-bis of the Consumer Code.

12.5 The user who resides in a member state of the European Union other than Italy, may also access, for any dispute relating to the application, execution and interpretation of these General Conditions of Sale, the European procedure established for small claims disputes, by Regulation (EC) no. 861/2007 of the Council, of 11 July 2007, provided that the value of the dispute does not exceed, excluding interest, fees and expenses, Euro 2,000.00. 13. Intellectual Property

13.1. The website as a whole, the products sold on the website and their packaging, and all elements that can be found on the website (such as brands, logos, drawings, shapes and models, illustrations, photos, texts, animations, videograms, phonograms, software, source codes and databases) are the exclusive property of Cbweed Brindisi or the owners of the intellectual property rights of the element in question. All these elements are protected by copyright, trademark law, industrial design law, patent law and sui generis rights.

13.2. Consequently, any reproduction, communication, download, modification or partial or total use of these elements belonging to Cbweed Brindisi. or to third parties, for any purpose or by any means of communication, requires prior written authorization from Cbweed Brindisi. or the respective owners of the intellectual property rights, except in cases where it is authorized by law. The user declares and guarantees that he/she has been informed that failure to comply with any of these obligations will expose him/her to civil and/or criminal proceedings.

14. Personal Data and Cookies

14.1 Cbweed Brindisi collects and processes the personal data of the user and, when necessary, the data of the recipient of the order. The collection of data is necessary for the management and execution of the order, as well as for the commercial relations between Cbweed Brindisi and the user. The data may be provided to contractual partners of Cbweed Brindisi for the execution of the order, such as management, processing, payment and delivery of the order. The information is also collected and stored for security reasons, in compliance with legal and regulatory obligations. Furthermore, the information collected allows Cbweed Brindisi. to send promotional offers and establish commercial relations with the user.

14.2 Cbweed Brindisi uses HTTP Cookies, defined as data files that are stored in the user's web browser when they access the website. The purpose of these data files, which record the user's navigation on the website, is to facilitate electronic communication, improve and personalize the quality of the website service and create statistics that measure visits to pages and the different features of the site.
